OPERATIONAL GUIDELINES FOR THE PRODUCTIVITY SUPPORT PROGRAM
On July 3rd, 2013, the Department of Labor and Social Welfare (“STPS” for its acronym in Spanish) published in the Federal Official Gazette (“DOF” for its acronym in Spanish) the operational guidelines for the Productivity Support Program (“PAP” for its acronym in Spanish) in the 32 states of the country, with the purpose of increasing the employability and productivity of workers.
The PAP consists of four components, being such:
Productivity and employability course.
Technical-legal assistance in productivity matters.
Specific training by skills.
Subsidies to the certification of labor skills.
The PAP’s target population is private sector workers who are enrolled in the Mexican Institute of Social Security (“IMSS” for its acronym in Spanish) and whose income amounts up to 10 minimum wages in force.
The PAP general operation mechanism is the following:
The companies, on behalf of their employees, shall present an aid application before the STPS, who will verify the eligibility of the workers and the company, and will make available to the latter the list of registered suppliers in order to identify the one who can meet the company’s needs under the PAP. Afterwards, the company and the supplier, together with the STPS, will subscribe the “PAP-01 Intervention Application Form”.
Once the services are provided, the workers shall fill out the “PAP-02 Registration of Beneficiary Workers Form” and deliver it to the supplier, who will refer it to the STPS in order to initiate the payment process.
The STPS will partially fund the costs of the courses taken by the workers, as well as the labor skill’s evaluation process of the company’s workers and the attainment of their respective labor skill’s certificate.
The amount of the subsidy depends on the kind of course to be provided and the number of workers to which it is addressed. The companies participating in PAP shall pay the remaining costs.

The present guidelines will become effective on the business day following its publication in the DOF and replace those published in the DOF on December 29, 2008.
